1. Scope and Provider
These Terms of Service apply to all purchases made by consumers through the online shop elfcloset-jewelry.com, operated by:

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession within the meaning of § 13 of the German Civil Code (Bürgerliches Gesetzbuch – BGB).
These Terms apply exclusively to purchases made by consumers. Any deviating terms proposed by the customer shall not apply unless expressly agreed otherwise.
2. Eligibility
Purchases through this online shop are only permitted to persons who have reached the age of 18 and have unlimited legal capacity.
By placing an order, you confirm that you meet these requirements.
3. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but a non-binding invitation to place an order.
By completing the checkout process and clicking the final order button, you submit a legally binding offer to purchase the goods in your cart.
The final order button is labelled in a manner that clearly indicates the payment obligation, such as “Zahlungspflichtig bestellen” or an equivalent legally compliant formulation.
After placing your order, you will receive an automatic email confirming receipt of your order. This automatic confirmation of receipt does not by itself constitute acceptance of your offer unless it expressly states that the order has been accepted.
The purchase contract is concluded when I accept your order by:
- sending a separate order or shipping confirmation;
- expressly declaring acceptance by email; or
- dispatching the ordered goods,
whichever occurs first.
If only part of the goods ordered is accepted, the contract is concluded only for the goods expressly accepted or dispatched.
The contract language is German or English, depending on the language selected during the ordering process.
The contractual provisions and order details are made available to you in the order confirmation and/or other contractual documents sent to you on a durable medium, such as email. Where available, order details may additionally be accessible through your customer account.
4. Prices and Payment
All prices stated in the online shop are total prices in euros and include applicable packaging costs.
As a small business within the meaning of § 19 UStG (German VAT Act), I do not charge or separately show VAT on invoices in accordance with the applicable small-business VAT rules.
Shipping costs are stated separately and are shown to you before you complete your order.
The payment methods available for a particular order are displayed during the ordering process. Depending on the destination, available payment methods may include PayPal, Klarna, Google Pay, Apple Pay, Shop Pay, credit and debit cards, and other payment methods made available through Shopify or its payment providers.
Payment processing is carried out by the respective payment service provider. I do not store your complete payment card details myself. Further information about payment processing and personal-data processing can be found in the Privacy Policy.
The price applicable at the time the order is placed applies to that order. Prices and promotional offers may change for future purchases without affecting orders that have already been placed.
5. Shipping and Delivery
I currently ship to Germany and other EU Member States, as well as Switzerland, Iceland, Norway and Liechtenstein, subject to the destinations and shipping methods available during checkout.
Available delivery destinations, shipping costs and delivery periods are displayed during the ordering process before you place your order.
Unless a different delivery period is expressly stated for a particular product or agreed with you, delivery will take place within the applicable statutory period. Where no other delivery period has been agreed, statutory delivery periods apply.
If an ordered item is unexpectedly unavailable after the contract has been concluded, I will inform you without undue delay. If I am unable to deliver the goods and the statutory requirements for withdrawal from the contract are met, any payments already made for the unavailable goods will be refunded without undue delay.
For consumers, the risk of accidental loss or accidental deterioration of the goods passes to you only when the goods are handed over to you or when you are in default of acceptance, in accordance with the applicable statutory provisions, including § 475 BGB.
For deliveries outside the European Union, additional import duties, customs charges, taxes or other fees may apply depending on the destination country. Unless expressly stated otherwise, such charges are the responsibility of the recipient.
6. Retention of Title
The goods remain my property until the purchase price has been paid in full.
7. Statutory Right of Withdrawal
Consumers generally have a statutory right of withdrawal of 14 days.
The detailed conditions, deadlines, procedure and legal consequences of exercising the right of withdrawal are set out in the separate Withdrawal Policy / Widerrufsbelehrung, which is made available to you before you place your order and forms part of the pre-contractual consumer information.
The statutory right of withdrawal does not apply in cases where an exclusion provided by law applies.
This may include, in particular:
- goods that are made according to the consumer’s specifications or are clearly personalized, where the statutory requirements for the exclusion are met; and
- sealed goods that are not suitable for return for reasons of health protection or hygiene, where the statutory requirements are met and the seal has been removed after delivery.
The withdrawal right is therefore not excluded merely because a product is jewellery or an earring; any exclusion is based on the applicable statutory requirements and the specific circumstances of the product and its packaging.

8. Statutory Warranty Rights
Your statutory rights in respect of defective goods remain unaffected.
If goods are defective, you are entitled to the statutory remedies. Depending on the circumstances and statutory requirements, these may include subsequent performance, such as repair or replacement. If the statutory requirements for further remedies are met, you may also be entitled to a reduction of the purchase price, withdrawal from the contract and/or damages.
For new goods sold to consumers, the statutory limitation period for claims based on defects is generally two years from delivery, subject to the statutory provisions and exceptions.
The statutory rules concerning the burden of proof and statutory presumptions regarding defects also apply.
No additional commercial guarantee is granted unless an additional guarantee is expressly stated for a specific product. Any such guarantee is in addition to, and does not restrict, your statutory rights.

Please provide your order number and, where appropriate, photographs or other information that may help identify the issue. This does not limit or condition any statutory consumer rights.
9. Product Care and Normal Wear
Jewellery should be handled and cared for appropriately.
Exposure to water, perfume, cosmetics, cleaning agents, chemicals, sweat or other substances may affect the appearance or condition of jewellery depending on the materials used. Improper use, improper care, accidents and ordinary wear and tear may cause damage for which statutory warranty rights do not apply.
Any care instructions provided with a product or on the product page should be followed.
Nothing in this section limits your statutory rights in respect of defects that existed at the time of delivery or otherwise fall within the statutory warranty provisions.
10. Liability
I am liable without limitation for damages resulting from injury to life, body or health where legally responsible, as well as for damages caused by intent or gross negligence.
Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.
In cases of slight negligence, I am liable only for the breach of obligations that are essential to the proper performance of the contract and on whose fulfilment you may ordinarily rely (cardinal obligations). In such cases, liability is limited to the foreseeable damage that is typical for the contract.
The above limitations do not apply where liability is mandatory under applicable law, including in cases where a guarantee has been expressly assumed or where liability cannot legally be excluded or limited.
11. Consumer Dispute Resolution
I am neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) within the meaning of the German Consumer Dispute Resolution Act (Verbraucherstreitbeilegungsgesetz – VSBG).
The European Union’s former Online Dispute Resolution (ODR) platform is no longer available and is therefore not used as a dispute-resolution mechanism by this shop.
12. Applicable Law
The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer habitually resident in another EU Member State, this choice of law does not deprive you of the protection afforded to you by provisions of the law of your country of residence that cannot be derogated from by agreement, in accordance with Article 6 of Regulation (EC) No. 593/2008 (Rome I).
13. Severability
If any provision of these Terms is or becomes invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
Mandatory statutory provisions remain unaffected.
