1. Scope and Provider

These Terms of Service apply to all orders placed by consumers through the online shop elfcloset-jewelry.com, operated by:

A “consumer” is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession (§ 13 BGB).

 

2. Eligibility

You must be at least 18 years old and have full legal capacity to enter into contracts in order to purchase from this shop.

 

3. Conclusion of Contract (Vertragsschluss)

The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to order (invitatio ad offerendum).

By clicking the order button at the end of the checkout process (“Buy now” / “Zahlungspflichtig bestellen”), you place a binding offer to purchase the goods in your cart.

After placing your order, you will receive an automatic email confirming receipt of your order (Bestellbestätigung). This confirmation does not yet constitute acceptance of your offer. A contract is concluded when I accept your order by sending a separate order or shipping confirmation, or by dispatching the goods; whichever occurs first.

The contract language is German or English. The contract text is stored by the shop system; your order details are sent to you by email and can also be viewed in your customer account, if you have one.

 

4. Prices and Payment

All prices are total prices in Euro, including packaging. In accordance with § 19 UStG (Kleinunternehmerregelung), no VAT is charged or shown on invoices. Shipping costs are displayed separately during checkout before you place your order.

Payment is processed securely via Shopify checkout. Available payment methods include PayPal, Klarna, Google Pay, Apple Pay, Shop Pay, major credit/debit cards (Visa, Mastercard, American Express, UnionPay), and local payment methods such as Bancontact and eps. I do not store your full payment card details myself; payments are processed by the respective payment provider (see the Privacy Policy for details).

Prices and promotions may change at any time; the price valid at the time you place your order applies to your order.

5. Shipping and Delivery

I ship to Germany and other EU countries as well as Switzerland, Iceland, Norway and Liechtenstein. Shipping costs and estimated delivery times are shown during checkout before you complete your order.

If an item is unexpectedly unavailable after you have ordered, I will inform you immediately and refund any payments already made without delay.

For consumers, the risk of accidental loss or deterioration of the goods passes to you only upon handover of the goods to you (§ 475(2) BGB).


6. Retention of Title (Eigentumsvorbehalt)

The goods remain my property until the purchase price has been paid in full.

 

7. Right of Withdrawal (Widerrufsrecht)

As a consumer, you have a statutory 14-day right of withdrawal. Details, exclusions (e.g. sealed earrings for hygiene reasons, personalized items), and the model withdrawal form can be found in the separate Return & Refund Policy (Widerrufsbelehrung) on this website, which forms part of these terms.


8. Statutory Warranty (Gewährleistung)

The statutory warranty rights under German law apply. If goods are defective, you are entitled to the statutory remedies (repair or replacement at your choice; if these fail, price reduction or withdrawal from the contract, and damages where the legal requirements are met). The warranty period for new goods sold to consumers is two years from delivery. Details on how to report a defect are in the Return & Refund Policy.

No additional commercial guarantee is granted unless expressly stated for a specific product.

 

9. Product Care Notice

Jewelry items are delicate. Damage resulting from improper handling, contact with water, perfume, or chemicals, or normal wear and tear does not constitute a defect within the meaning of the statutory warranty.


10. Liability

I am liable without limitation for damages resulting from injury to life, body, or health, for intent and gross negligence, and under the German Product Liability Act (Produkthaftungsgesetz).

For slightly negligent breaches of essential contractual obligations (Kardinalpflichten — obligations whose fulfillment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely), my liability is limited to the foreseeable damage typical for this type of contract. Any further liability for slight negligence is excluded.

 

11. Dispute Resolution

I am neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) within the meaning of the German Verbraucherstreitbeilegungsgesetz (VSBG).


12. Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer residing in another EU country, this choice of law does not deprive you of the protection of mandatory consumer protection provisions of the law of your country of residence (Art. 6(2) Rome I Regulation).

 

13. Severability

Should individual provisions of these terms be or become invalid, the validity of the remaining provisions remains unaffected.
