1. Right of Withdrawal

If you are a consumer, you generally have the statutory right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which you, or a third party designated by you who is not the carrier, acquire physical possession of the goods.

If you have ordered several goods as part of one order and the goods are delivered separately, the withdrawal period begins on the day on which you, or a third party designated by you who is not the carrier, acquire physical possession of the last goods.

If goods are delivered in several partial shipments or pieces, the withdrawal period begins when you acquire physical possession of the last partial shipment or last piece.

To exercise your right of withdrawal, you must inform me of your decision to withdraw from the contract by means of a clear statement, for example by email or post, using the following contact details:

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of your right of withdrawal before the withdrawal period has expired.

2. Effects of Withdrawal

If you withdraw from this contract, I will reimburse all payments received from you, including the cost of delivery, except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by me.

I will make the reimbursement without undue delay and in any event no later than 14 days from the day on which I am informed of your decision to withdraw from the contract.

I will use the same means of payment that you used for the original transaction, unless we have expressly agreed otherwise. You will not be charged any fees as a result of the reimbursement.

I may withhold reimbursement until I have received the goods back or until you have provided evidence that you have sent the goods back, whichever occurs earlier, unless I have offered to collect the goods myself.

3. Returning the Goods

You must send the goods back or hand them over to me without undue delay and in any event no later than 14 days from the day on which you communicated your decision to withdraw from the contract.

The return deadline is met if you send the goods before the 14-day period has expired.

You bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

You may inspect the goods in a manner comparable to what would reasonably be possible in a shop. If you handle, wear or use the goods beyond what is necessary to establish their nature, characteristics and functioning, you may be liable for any resulting loss in value where the statutory requirements are met.

4. Exclusions from the Right of Withdrawal

The statutory right of withdrawal does not apply in cases where an exclusion under § 312g(2) BGB applies.

This includes, in particular:

Personalized or individually made goods

The right of withdrawal does not apply to goods that are not prefabricated and for whose production an individual selection or specification by the consumer is decisive, or goods that are clearly tailored to the consumer’s personal requirements, where the statutory requirements for the exclusion are met. This may include genuinely personalized or custom-made jewellery.

Certain sealed hygiene products

The right of withdrawal expires in relation to sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

Where earrings or other jewellery are supplied in sealed packaging that qualifies under this statutory provision, the right of withdrawal may therefore expire once the seal has been removed.

The exclusion does not apply merely because an item is jewellery or an earring; the statutory requirements must be met in the individual case.

5. Defective or Incorrect Items – Statutory Warranty Rights

Your statutory rights in respect of defective goods are separate from and unaffected by your right of withdrawal.

If an item is defective or does not conform to the contract, you are entitled to the statutory remedies.

As a general rule, you may choose between repair and replacement, subject to the statutory provisions, including the seller’s right to refuse a particular form of subsequent performance where the statutory requirements are met.

If subsequent performance fails, is refused, is impossible or the statutory requirements for further remedies are otherwise met, you may be entitled to a reduction of the purchase price, withdrawal from the contract and/or damages.

For defective or incorrectly delivered goods, I will bear the necessary costs of returning the goods and the other costs required for statutory subsequent performance.
